01Definitions
- Platform: the WGTK website, applications and services, including the dashboard and the booking pages.
- Subscriber or business: any commercial or professional activity that created an account on the platform to manage its appointments.
- Customer: anyone who books an appointment with a business through its page on the platform.
- Plan: the subscription package chosen by the subscriber, with the features and price shown on the platform.
02Account and subscription
- The subscriber must be licensed to provide the services it offers, and is responsible for keeping its details accurate and current.
- The account holder must be 18 or older and authorised to represent the business.
- The account holder is responsible for keeping sign-in details confidential and for everything done through the account and its staff accounts.
- We may refuse or suspend a registration that breaches these terms or the law.
03Plans, prices and payment
- Prices are shown in Saudi riyals on the pricing page and in the dashboard. The price shown is the final amount charged, inclusive of VAT where it is legally due, with no hidden fees.
- The free trial lasts 4 months with every feature and needs no card. When it ends without a subscription, the dashboard and the booking page pause while the data is kept, and they return as soon as the subscriber chooses a paid plan.
- A paid subscription is paid in advance for each subscription period using one of the payment methods available in the dashboard, and starts once payment is confirmed. An invoice is issued for every payment.
- We may change prices by emailing subscribers at least 30 days in advance; the new price applies from the next renewal.
04Subscription cancellation and refunds
- A subscriber may cancel at any time from the dashboard or by contacting us. Plan features stay available until the end of the paid period, after which the subscription does not renew.
- A new subscriber paying for the first time may request a full refund within 7 days of payment, no reason required.
- Otherwise, amounts paid for a subscription period that has started are non-refundable, unless we could not provide the service because of a material fault on our side that we failed to fix within a reasonable time, in which case we refund the unused part of the period.
- Refunds are made to the original payment method within 14 days of the request being accepted.
05Booking pages and the business-customer relationship
The platform is a technical intermediary that lets a business receive bookings. The service contract itself (the haircut, session, table reservation and so on) is made directly between the customer and the business. Accordingly:
- The business alone is responsible for providing the service, its quality, prices and timing, and for any amount the customer pays it.
- The business must publish its cancellation and rescheduling policy from its account settings; the platform shows it to the customer before the booking is confirmed, and the business is bound by what it published.
- Payments a customer makes through the payment gateway go to the business's own gateway account, and the business is the merchant responsible for any refund of them.
- The business must comply with the E-Commerce Law and the Personal Data Protection Law towards its customers, and must not use customer data for anything other than the purpose they booked for, except writing to its own customers with occasion messages and offers through the platform's tools while honouring any customer's request to stop them. It uses a customer's attendance numbers on WGTK only to plan its own appointments and never passes them on.
06E-invoicing
E-invoicing is an optional feature for businesses registered for VAT. When it is on, the platform issues the business's tax invoices and notes and reports them to the Zakat, Tax and Customs Authority; the business remains the taxpayer responsible for the accuracy of its tax details, for its registration on the Fatoora portal and for paying its taxes.
- The business enters its legal name, VAT number, registration and national address exactly as the authority holds them, and keeps them up to date.
- The digital certificate the authority issues to the business through the platform belongs to the business and is renewed from its panel when it expires.
- Issued documents are never edited or deleted; a sale is corrected with a refund and a credit note.
- The platform takes the usual care to report within the legal windows; it is not liable for a document the authority rejects because of details the business entered, nor for penalties arising from the business not registering or registering late.
07Booking terms for customers
- By completing a booking the customer agrees to these terms, the privacy policy and the business's published cancellation policy.
- The customer must enter accurate details that belong to them (their name and mobile number), and attend the appointment or cancel or change it in good time so others are not deprived of it.
- A business may ask a customer who often misses its appointments to pay online before the booking is confirmed, or to book through the business directly; the customer is told before the booking is completed.
- Appointment confirmations and reminders are service messages needed to complete the booking.
- To cancel or change an appointment, the customer contacts the business through the contact options on the booking page or in the confirmation message.
- Fake or repeated bookings intended to harm a business breach these terms, and both the business and the platform may refuse them.
- From the customer's bookings on WGTK the platform works out an overall rating of how they keep appointments and overall numbers about their bookings, and shows them to the businesses they book with as numbers only, as the privacy policy describes.
08The invite-a-friend programme and WGTK credit
The platform may grant customers promotional credit ("WGTK credit") for inviting friends who make their first booking through the platform, or as a welcome gift on a first booking. The credit is a promotion by the platform, not money and not an electronic wallet.
- Credit cannot be redeemed for cash or transferred to another person; it is spent only to reduce the price of a booking made through the platform, and it lapses after the period shown in the customer's account if unused.
- The inviter's reward is counted once the friend has actually attended their first appointment and a holding period has passed; cancelled, missed or refunded visits do not count. A customer who has booked through the platform before, under any number, is not a new friend.
- The platform sets the amounts, conditions, limits and budget of the programme and may change them or stop the programme at any time; a change applies to later bookings and does not touch credit already issued.
- Sham invitations, reciprocal bookings made to obtain credit, or several numbers for one person breach these terms; the platform may cancel the credit they produced and close the programme to whoever made them.
- When credit is spent at a business, the platform reimburses the business for it under their agreement; this does not affect the business's invoice to its customer or its rights.
- The inviter's and the friend's mobile numbers are processed only to run the programme and prevent its abuse, under the privacy policy; neither sees the other's full number.
09Refunds between a business and its customers
Whether to refund a customer is the business's decision under the policy it publishes to its customers. The business records every refund in its panel, whole or partial and with its reason, so it shows in its books and, with e-invoicing on, a credit note is issued for it.
- Amounts paid by card through the platform go back to the customer's card through the same payment gateway, show within five to ten business days depending on the bank, and are deducted from the business's later payouts.
- Amounts paid in cash, by card terminal or by transfer are handed back by the business itself and recorded on the platform.
- A booking that has a tax invoice is not deleted from the platform; it is cancelled or refunded.
10Acceptable use
No user of the platform may:
- Use it for any activity that breaks the law or public morals, or to offer services it is not licensed for.
- Send marketing or nuisance messages through the platform's tools to anyone who has not agreed to receive them.
- Upload content (logos, images, text) that infringes others' rights or offends public decency.
- Attempt unauthorised access to others' accounts or data, scrape data automatically, or interfere with the platform's stability.
- Resell the platform or offer it to others as a service without a written agreement with us.
On a breach we may suspend or terminate the account, notifying the subscriber where possible, without prejudice to our right to compensation.
11Content and intellectual property
- The subscriber keeps ownership of its content (name, logo, images and customer data) and grants us a limited licence to display and process it only as far as needed to run the service.
- The platform, its software, design and brand belong to WGTK and may not be copied, modified or used outside the scope of these terms.
12Processing data on the subscriber's behalf
For the business's customer data, the business is the controller and we are the processor, and we undertake to:
- Process customer data only on the business's documented instructions and for running the service, never for our own purposes. The one exception is the customer's appointment rating and the overall numbers about their bookings across the platform described in the privacy policy: we work them out as the platform provider from the customer's bookings with every business and show them as numbers only, never anything that identifies another business, its services or its amounts.
- Apply the security measures described in the privacy policy and limit access to those who need it for their work.
- Read WhatsApp conversations between the business and its customers only when needed: when the business reports a conversation to us, or to fix a problem in the service or in the assistant's replies. Every access is logged with its reason, and customer numbers are shown to support partly hidden.
- Help the business answer data subject requests (access, correction, deletion) within the legal deadlines.
- Inform the business without undue delay of any security incident affecting its customers' data.
- Use sub-processors (hosting, messaging, payment gateways) under contracts imposing equivalent obligations, and inform the business of any material change to them.
- Delete customer data or return it to the business when the subscription ends, as set out in the privacy policy, unless the law requires us to keep it.
13Availability and limitation of liability
- We make reasonable efforts to keep the platform available around the clock. It may pause for maintenance or for reasons beyond our control, and we aim to give notice of scheduled maintenance.
- We are not responsible for the services businesses provide to their customers, nor for outages of third parties such as telecom carriers, payment gateways and hosting providers.
- We are not liable for indirect losses or lost profit. In all cases our total liability to a subscriber is limited to the fees it paid us in the 12 months before the claim.
- Nothing above excludes any right that the law does not allow to be excluded by agreement.
14Ending the agreement
- The subscriber may end its subscription at any time as described in the cancellation and refunds section.
- We may terminate an account for breach of these terms or non-payment, after notifying the subscriber and allowing a reasonable time to remedy the breach where it can be remedied.
- On termination the subscriber can export its data from the dashboard before the account is closed; the data is then deleted as set out in the privacy policy.
- The intellectual property, limitation of liability and governing law sections survive termination.
15Changes to these terms
We may amend these terms from time to time. The updated version is published here with its date, and material changes are notified to subscribers by email or in the dashboard at least 15 days before they take effect. Continuing to use the platform after that date counts as acceptance.
16Governing law and disputes
These terms are governed by and interpreted under the laws of the Kingdom of Saudi Arabia. In a dispute we first seek an amicable solution through our contact channels; failing that, the competent judicial authorities in the Kingdom have jurisdiction. Consumers may also complain to the Ministry of Commerce, the authority responsible for enforcing the E-Commerce Law.
